1994 Acura Legend not running right but not due for smog test this year either. Can I turn it into the buy back program?

I have a 1994 Acura Legend that is not due for smog this year but has had non-stop mechanical problems. I have put in a lot of money into this car over the last year and it still is not running correctly...I have replaced the catalytic converter, motor mounts, tires and got countless alignements and balances...

Can I turn it in to the buy back program to buy a newer car?
