Selling used 2002 Mitsubishi Lancer without smog certification AS IS

I have a used 2002 Mitsubishi Lancer with 137k miles on it. I bought a new car and just trying to sell this Lancer AS-IS. I no longer want to spend or put in more money on fixing it.

I did pay for the registration but the smog didn't pass. Can I sell it AS-IS without the smog passing? I know by law in California I'm repsonsible to take care of the smog first before I sell. Is there any other options for me to sell this car AS IS without the smog check passing whether it's to sell to a private party whose willing to get the smog test to pass or to someone or a compnay that's willing to purchase used cars AS IS without smog check? Please advise! THANKS!

Answer:  

You need a smog check when selling a used vehicle to a private party and/or business which is not automotive leasing, sales, dismantling, loan, or repair related. There is one exemption to selling your car without a smog certificate but it requires first turning your Lancer's current registration to Non-Operational (through the DMV) and then sell the Lancer as a non-op with no smog certificate. There is no law prohibiting the sale of a non-operational vehicles. Non-operational vehicles are usually not in an emissions test ready state.
