Stuck with Toyota Camry that won't pass smog test

My relative bought a 1996 Toyota Camry and it passed the smog test within 90 days prior to sale date. Within a week or two, the "Check Enging Light" came up. We had the car checked out by a mechanic who works for a Toyota dealership and he said the catalytic converter w/ the Oxygen Sensor ,or O2, went bad. A chunk of the material inside looked like it cut off. My question is can my relative take the seller or previous owner on file of the vehicle to small claims court to recover the cost of the repair?


Answer:  

There's nothing that says a buyer can not sue a seller for any reason. Small claims court is always an option. Whether one could win a case such as this needs to be discussed with an attorney.

We'd imagine in this case the seller fulfilled their obligation in terms of providing a valid and passing smog check. It becomes the buyers responsibility to ensure the vehicle is in the condition they wish to purchase one in. Used vehicles are usually sold as-is.
