Smog Tech Never Told Me I Would Fail for Check Engine Light

My 1998 Toyota Camry failed because check engine light was on. I want to know why the smog technician didn't inform me that my Toyota will fail because the light was on. He saw the check engine light was on when I drove the car to the smog station. I'm upset and feel I was cheated.


Answer:  

The fact is California law requires smog stations conduct smog inspections to vehicles as they are driven into the smog test facility. It is against BAR regulation to inform a vehicle owner that the vehicle will not pass the smog test prior to conducting the inspection. The BAR has set forth this policy in order to collect accurate emissions data from vehicles currently being operated on California roadways.

Had the smog technician in this specific case told you your Toyota Camry will fail the smog check if he proceeds with the inspection, he would have been breaking California law and stand to receive a fine and penalty from the State.
